NHBC Part L: What you should know about the new Part L changes

The National House Building Council or NHBC are involved in Part L because they are a home warranty provider and therefore provide certification based on and around the new Part L changes and overall building regulations.

The warranty provider is the one who signs off on the Part L document so they can issue the certificate for the property.

There are 3 main home warranty providers in the UK for Part L:

  • NHBC - National House Building Council
  • Premier Guarantee
  • LABC - Local Authority Building Control

HNBC new Part L

One of the key requirements under the new Part L of the building regulations is the Part L Photographic Evidence requirement to record photographic evidence of the as-built construction details.

Initially, this evidence needs to be authorised by your energy assessor and the building control body before sign off of the construction can occur and before an EPC can be lodged.

And then during construction project delivery, photographic evidence must be captured, stored and made available for review to the home warranty providers like the National House Building Council - HNBC.

Photos are therefore required to be taken during construction and prior to production of the Energy Performance Certificates and the Building Regulation England Part L Report output compliance report.

The Part L changes came into effect in June 2021.

The Part L Photographic Evidence requirement is a hard requirement for building work started after 15th June 2023, which many existing projects already adhering to the standard from the initial 15th June 2022 start date.

Part L is essentially future proofing homes for future regulatory requirements, including the stricter regulations legislated for 2025.

Any legislation change carries some anxiety for builders, as they need to assess their own systems, inputs and performance to ensure they are adhering to the new legislation and changes.

With the changes to Part L and the new requirements on home warranty providers like the NHBC, the most important change for builders is that they can properly capture, store and then make available the photographic evidence to prove they have met the legislation requirements.

For most companies, capturing photo evidence has been a bit of an afterthought, with photos for safety issues, dilapidation, defects and general progress being the main focus.

With these changes, photos become a deeper part of quality and risk control, meaning they have even higher commercial value for your business.

The photographic standards have also increased, with every photo needing to be high enough resolution to allow a qualitative audit of the subject detail, geo-location enabled to show date, time and location of each image, and a file name to include plot number and reference according to the property detail so photos are traceable.

Thankfully, many building companies have been using mobile apps and applications which make photo capture easy and intuitive on site for workers, and then automates the management of those photos back in the office to meet legislative requirements as well as good site record hygiene.

A good time to brace for more change and legislation in the building industry

Systems have been a low priority for builders for many years.

The last 20-30 years have seen a massive increase in documentation requirements in the UK and other countries, and the legacy systems haven't changed at all - paper, word, excel, PDF.

Any modern makeshift apps adapted to building company operations like whatsapp certainly weren't designed to handle complex photo or information management amongst multiple stakeholders on building sites.

New stricter reporting and documentation requirements are forcing building companies to adapt with a more modern approach to systems.

Adhering to these standards is pretty easy and almost automatic with the right systems in place, but a massive headache and information nightmare without good systems.
