What is a Extension of Time (EOT)?

Construction contracts generally allow the construction period to be extended where there is a delay that is not the contractor's fault - described as an EOT or extension of time. EOT's can arise for a number of reasons including adverse weather, civil commotion or a delay in gaining possession of site - amongst other things.

When there is a foreseen or current delay which warrants an EOT, the contractor gives written notice to the other parties identifying the relevant event that has caused the delay. The contract administrator can then grant an EOT and adjust the date for practical completion.

What are the common reasons for extensions in construction?

The construction industry is notorious for sudden changes that might stray far away from the plans and contracts set, that's why if these unforeseen changes push back a project, the contractors can request an Extension of Time (EOT). These are the most common reasons the contractors request for more time working on a project:

  • Natural phenomenon, bad weather, heavy rain, storms, etc., among other things we can't control because of nature.
  • When contractors somehow can't get access to the site, whether accessibility or permit concerns
  • Delays in material delivery
  • Last-minute changes to designs, drawings, plans, etc.

What should be included in your EOT?

Contract follow a standard or guidelines, depending on the company, but the EOT doesn't really have a strict template it follows. Here are common elements in the EOT that need to be included:

  1. Contract and project information
  2. Clear explanation any reason for the delay. This section should be backed up with the necessary documents, evidence, photos, videos, etc as long as necessary
  3. How it affects the project and the contract (the dates affected)
  4. Approval section

How does an EOT become part of the contract?

The EOT document becomes part of the contract as proof that there was a request to extend the project timeline, as a way to make things official. This is right after the contractors send over the request, it's reviewed, and approved. After that, everyone involved in the project should be notified for any changes and adjust accordingly.
